Terms of Service

1. Provider

These Terms govern access to and use of ArtHome CRM, proprietary software developed, owned and operated by SMILING ATMOSPHERE – LDA, NIPC 517944596, with registered office at Rua Capitão Salgueiro Maia, nº 3, 2925-228 Azeitão, Setúbal, Portugal ("Smiling Atmosphere", "we", "us" or "our"). 2. Authorized business service

ArtHome CRM is a restricted business service. It is not a public consumer account service. Access is available only to organizations and individuals authorized by Smiling Atmosphere or an approved business customer. Additional commercial, support, data-processing or service-level terms may apply under a separate written agreement.

3. Accounts

Users must provide accurate account information, keep credentials confidential, use individual accounts, follow multi-factor authentication requirements where enabled, and notify us promptly of suspected unauthorized access. The organization that requested an account is responsible for promptly updating or removing access when a person changes role or leaves.

4. Permitted use

Users may use ArtHome CRM only for lawful business purposes within their assigned role, including lead management, sales and branch workflow, scheduling, customer follow-up, reporting and approved integrations. Users may access only the data and functions they are authorized to use.

5. Prohibited use

Users must not: access another user's account; bypass security or permissions; scrape, copy or export data without authority; upload malware; interfere with availability; reverse engineer the service except where law cannot prohibit it; use personal data for discrimination, surveillance or prohibited eligibility decisions; store unnecessary sensitive data in free-text fields; sell Meta Platform Data; or use the service in violation of law, Meta terms or a controller's instructions.

6. Customer data and responsibilities

The business customer remains responsible for the lawfulness, accuracy and instructions governing data it enters or connects to ArtHome CRM; for providing privacy notices and obtaining permissions or consent where required; for assigning appropriate user roles; and for responding to individuals' requests as controller. Smiling Atmosphere processes customer-controlled data as described in the applicable data processing agreement and Privacy Policy.

7. Meta integrations

Meta integrations are optional and require appropriate authorization to the relevant business assets. Functionality may include receiving lead notifications, retrieving form responses and advertising context, and sending selected lead-status events through Meta APIs. Users must comply with Meta Platform Terms and applicable policies. Smiling Atmosphere does not control Meta availability, review decisions, API changes or account restrictions.

8. Intellectual property

ArtHome CRM, including its software, architecture, interface, documentation and associated materials, is owned by Smiling Atmosphere or its licensors and is protected by applicable intellectual-property law. Subject to the applicable agreement, authorized users receive a limited, non-exclusive, non-transferable and revocable right to use the service during the authorized period. No ownership rights are transferred. Third-party names, logos and content remain the property of their respective owners.

9. Feedback

If a user provides product feedback, Smiling Atmosphere may use it to improve ArtHome CRM without restriction or payment, provided that this does not grant us a right to use the user's confidential information or personal data for unrelated purposes.

10. Availability and changes

We aim to maintain a reliable service but do not guarantee uninterrupted availability. Maintenance, security events, third-party outages and changes to law or APIs may affect the service. We may update functionality, security controls and integrations. Material changes that affect contracted use will be handled under the applicable agreement.

11. Confidentiality and security

Each party must protect confidential information it receives and use it only for the agreed purpose. Users must follow security instructions and must not disclose access tokens, app secrets, passwords or confidential data. Security issues should be reported through the ArtHome CRM Security page.

12. Fees, purchases and refunds

ArtHome CRM does not currently offer public self-service purchasing through this website. Fees, payment terms, renewals, cancellation and any refund rights are governed by the applicable order form or written commercial agreement. The separate refund page for other services does not apply to ArtHome CRM. If public paid plans are introduced, a dedicated billing and refund policy must be published before checkout is enabled.

13. Suspension and termination

We may suspend access where necessary to address security risk, non-payment under an applicable agreement, unlawful use, material breach, or risk to Meta or third-party systems. On termination, access ends and data is returned or deleted in accordance with the applicable agreement, controller instructions, legal obligations and retention schedule.

14. Disclaimers

To the extent permitted by law, ArtHome CRM is provided on an "as available" basis and third-party integrations are subject to their providers. Nothing in these Terms excludes mandatory rights or liability that cannot lawfully be excluded.

15. Liability

Liability is governed by the applicable commercial agreement and mandatory law. Before external commercial launch, Portuguese counsel must confirm any limitation-of-liability language and ensure that it is consistent with the negotiated customer contract. These Terms do not limit liability where limitation is prohibited by law.

16. Governing law and disputes

Unless a written agreement states otherwise and subject to mandatory law, these Terms are governed by the laws of Portugal. The parties should first attempt in good faith to resolve a dispute through the contacts in their agreement. Any jurisdiction clause must be aligned with the signed commercial agreement before publication.

17. Changes

We may update these Terms. We will publish the updated date and provide additional notice where required by law or contract. Continued use after the effective date is subject to the updated Terms, except where express acceptance is required.
